The services to be provided by the coach, Tom Douce, to the client are conducted online via video and/or audio software, as agreed jointly with the client. Coaching may address specific personal and business projects and successes, and/or general conditions in the client’s life or profession. Coaching services include value clarification, brainstorming, identifying plans of action, examining modes of operating in life, asking clarifying questions, and giving empowering advice or suggestions for action.
Throughout the working relationship, the coach will engage in direct and personal conversations. The client understands that successful coaching requires a co-active collaborative approach between client and coach. In the coaching relationship, the coach plays the role of a facilitator of change, but it is the client’s responsibility to enact or bring about the change after the session completion. If the client believes the coaching is not working as desired, the client will communicate and take action to conclude coaching relationship.
You are encouraged to read the Coaching Information page as a way of more fully understanding what coaching with Tom Douce is about and how to get the most out of it.
The coach will work within the professional ethics and guidelines as designated by the International Coaching Federation. Copies of the ethical guidelines are available on the website. All information about the coach / client relationship will remain strictly confidential except in very rare circumstances where decreed by law; ie. where the court might issue a subpoena for the file or information.
If you wish for Tom Douce as your coach to speak to someone outside of personal interactions, then you need to give Tom Douce signed written permission (physical letter or email) to do so. Exceptions to confidentiality of course relate to extreme circumstances such as intent to seriously harm someone or commit child abuse etc. Otherwise, all of your information is confidential.
The client can, at any point in the coaching session, declare his/her preference not to discuss a specific issue, by simply stating that they would rather not discuss this issue. The coach agrees to respect this boundary and will not attempt to forward the conversation further along those lines.
Coaching and counselling or therapy are not the same as described by the America Psychology Association and as such, there needs to be a clear distinction between the two.
Even though Tom Douce had has professional training in life coaching, he does not engage in counselling or therapy with coaching clients. In entering into the coaching relationship, and agreeing to the terms and conditions, you are agreeing that if any mental health difficulties arise during the course of the coaching relationship, you will notify Tom Douce immediately so that he can discuss with you an appropriate referral. Alternatively, you may disclose at this point you have referee partners in these professions.
Termination and Refund
In order to cancel a session and receive a refund, the client agree to provide 24 hours notice prior to the single coaching session and one week in the event that it is desired to terminate an ongoing coaching relationship. Otherwise, the coaching sessions will continue for the duration of the scheduled coaching period.
For coaching services that are paid for in advance, refunds for remaining sessions as identified at the time of agreed termination will be made accordingly without further enquiry.
Except as expressly provided in these terms and conditions (T&Cs), the Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Client for any indirect, consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under these T&Cs, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under these for all coaching services rendered through and including the termination date.
Terms & Conditions
This document reflects the entire agreed upon T&Cs between the Coach and the Client, and reflects a complete understanding of the parties with respect to the subject matter. These T&Cs supersedes all prior written and oral representations. These T&Cs may not be amended, altered or supplemented except in writing signed by both the Coach and the Client.
If a dispute arises out of these T&Cs that cannot be resolved by mutual consent, the Client and Coach agree to attempt to mediate in good faith for up to (certain amount of time such as 30 days) after notice given. If the dispute is not resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party.
If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of these T&Cs is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this Agreement.
These T&Cs shall be binding upon the parties hereto and their respective successors and permissible assigns once the checkbox ‘yes’ is selected in all coaching application forms relating to coaching services provided by Tom Douce. Please refer to these T&C prior to the first scheduled coaching meeting and retain access to the T&Cs (via the website link or by requesting a soft-copy from Tom Douce) after the coaching relationship has concluded.
